"The NHL Hat Trick Challenge - PLAYOFFS Presented by Enterprise" (the "Promotion") is sponsored by NHL Enterprises, L.P., 1185 Avenue of the Americas, 13th Floor, New York, New York 10036 ("Sponsor").
In order to enter the Promotion and be eligible to win a prize, entrant must be a current legal resident of the United States (including District of Columbia) or Canada who is of the age of majority or older as of the date of entry into the Promotion in their State (or District of Columbia, as applicable) or Province of primary residence at the time of entry (each such eligible United States or Canadian resident, as applicable, an "Entrant"). Entry is free and no purchase is necessary to participate at any time in the Promotion. The Promotion is void where prohibited by law. Employees, officers, and directors of Sponsor, the National Hockey League and its Member Clubs, NHL Enterprises Canada, L.P., NHL Enterprises B.V., NHL Interactive CyberEnterprises, LLC, Enterprise Holdings, Inc. and each of the foregoing entities' affiliates, licensors and prize providers, and any other person or entity associated with the development or administration of this Promotion (collectively, the "Promotion Entities"), as well as such person's immediate families, namely spouses, children, siblings and parents, and/or persons living in the same household as such persons, whether or not related, are not eligible to enter this Promotion or win a prize.
The Promotion begins at 9:00 a.m. Eastern Time on April 15, 2014 and ends upon the start time of the last Stanley Cup Final game of the 2013-2014 NHL Stanley Cup Playoffs (the "Promotion Period"). The Promotion Website's (as defined below) computer is the official clock for all purposes of the Promotion.
There are two (2) methods to enter and participate in the Promotion during the Promotion Period. An Entrant can enter by (1) visiting the Promotion website located at www.hattrick.nhl.com (the "Promotion Website") or (2) downloading and opening the free NHL Hat Trick Challenge mobile application (the “App”), available for download on iPhone and Android mobile devices. Before entering, an Entrant must first register (“Registration”) for an account with www.NHL.com. It is free of charge to register for an account. If an Entrant does not already have an NHL.com account, the Entrant can register for one at the Promotion Website or through the App by clicking on the “Register Now” link within the “Log In To NHL.com” box. Then follow the instructions to complete and submit the registration form by providing the required contact information including user name, email, country, zip/postal code, birth date, favorite team (not required for Canadian Entrants) and the selection of a password. After registering for an NHL.com account, the Entrant can log in at the Promotion Website or through the App and complete the entry process by creating an entry name (the “Entry”). Once an Entrant has created an Entry the Entrant can then participate in the Promotion by answering three daily questions based on NHL games during the 2013-2014 NHL Stanley Cup Playoffs (the “Playoffs”) as further described in the “How To Play” section below in these Official Rules. An incomplete entry or registration form does not constitute a valid Entry for purposes of participating in this Promotion and will not be accepted.
LIMIT: ONE (1) REGISTRATION AND ENTRY PER PERSON AND PER EMAIL ADDRESS DURING THE PROMOTION PERIOD. No person may enter more than once by using different email addresses and no email addresses can be used to submit more than one (1) Entry or Registration. Proof of submitting an Entry or Registration will not be deemed by Sponsor as proof of receipt or entry into the Promotion. Any attempted form of entry into the Promotion other than as described herein is void. Entries from the same person and/or email address in excess of the number stated herein will be disqualified. Any attempt by an Entrant to use multiple email accounts will result in disqualification. Any use of robotic, repetitive, automatic, programmed or similar entry methods or agents will void all Entries by that Entrant. Entries that are incomplete, garbled or corrupted are void and will not be accepted. All Entries become the property of Sponsor upon receipt and will not be acknowledged or returned.
After an Entrant has submitted a valid Entry and Registration in accordance with these Official Rules, the Entrant may participate in the Promotion by answering three daily questions based on NHL games.
General: The objective of the Promotion is to accumulate the most "hat tricks" by correctly answering three different questions predicting certain outcomes in the NHL games over the course of the Playoffs, which questions will be posted on the Promotion Website and the App no later than 9:00 a.m. Eastern Time on the day of the NHL game(s) to which the questions apply. For each day of the Playoffs in which games are scheduled, there will be 3 new questions to be answered. The Entrant who has accumulated the most “hat tricks” during the Playoffs will be the potential winner of the Promotion, and once that Entrant has been confirmed as the actual winner (in accordance with Section 7 below) that Entrant will receive the Grand Prize.
Make Predictions/Selections: Once a registered Entrant has logged into the Promotion Website or the App, the Entrant will arrive at a page or a widget to answer three questions of a predictive nature about NHL games. There will be a new set of questions to be answered for each day during the Playoffs on which games are scheduled. An Entrant must answer each of the three questions by following the instructions on the Promotion Website or the App. Answers to questions posted on a given day during the Playoffs must be submitted and locked in prior to the Eastern Daylight Savings start time of the first game scheduled for that day’s Playoff games. If Entrant is a resident of Canada, these questions do not constitute the skill-testing question required to be correctly answered in order to win the Grand Prize. To be eligible to win the Grand Prize, an Entrant does not have to participate in each period of the Promotion or answer the three questions for each and every day that different questions are posted.
Scoring/Winner Selection: In order to score a "hat trick," the Entrant must correctly answer all three questions for the day in which new questions are posted. The odds of winning depend on the number of eligible entries received and the skill of each Entrant in his or her knowledge of the NHL teams and in selecting the correct answers needed to earn a "hat trick" during the various periods of the Promotion Period.
At the end of the Playoffs, the Entrant with the highest total number of "hat tricks" will be deemed the potential winner of the Promotion.
Tie Breaker: If more than one Entrant has the highest total number of "hat tricks" for the entire Playoffs, the Entrant involved in the tie with the highest total number of correct answers during the entire Playoffs shall be deemed the winner of the Promotion. For the tiebreaker, in the event that more than one Entrant involved in the tie shall also be tied for the highest total number of correct answers for the Promotion Period, then one (1) winner shall be selected from those tied Entrants by a random drawing conducted by the Sponsor-designated judges.
Group/League Play: In addition to participating in the Promotion on an individual basis, each Entrant may also participate in group or league play by either setting up his or her own group or by joining another group already established by another Entrant. Entrants within a particular group/league compete against one another by using the same picks made by such Entrants in individual play. The Entrant with the highest score within a particular group/league will be deemed to be the winner of that group/league. Participating in group or league play is only for bragging rights and Entrants will not be entitled to any prize whatsoever on account of having the highest score in a particular group or league. An Entrant must have the highest overall score among all Entrants participating in the Promotion in order to be eligible to win the Grand Prize.
In order to enter the Promotion or receive a prize, Entrant must fully comply with the Official Rules and, by entering, Entrant represents and warrants that Entrant agrees to be bound by these Official Rules and the decisions of the Sponsor-designated judges, whose decisions shall be binding and final in all respects relating to this Promotion.
The potential winner of the Promotion will be notified using the information provided on winner's Entry or Registration. The potential winner will be notified by email and/or telephone, at Sponsor's discretion, within ten (10) days after the conclusion of the Promotion Period.
A potential Grand Prize winner must comply with all terms and conditions of these Official Rules. Winning is contingent upon fulfilling all requirements. A potential winner is not an official and confirmed winner until he/she has completed, signed and returned all documentation required by Sponsor in its sole discretion, including, but not limited to, an Affidavit of Eligibility, Publicity Release (except where prohibited by law) and Liability Waiver (together, the "Release Forms"), and the eligibility of the potential winner has been verified. In the event the potential winner is from Canada, before that person is declared the actual winner, that person must first correctly answer, without mechanical or other assistance, Sponsor's mathematical, skill-testing question that will form part of the Release Forms. The potential winner must complete and return all necessary Release Forms. All Release Forms must be received within ten (10) days after notification of winning. If a potential winner does not complete and return to Sponsor all Release Forms necessary within the time given, he/she will forfeit the Grand Prize and an alternate winner may be chosen at Sponsor's discretion. Promotion Entities are not responsible for documents not received within the required timeframe. All decisions of Sponsor and/or its designees shall be binding and final (except in the case of a potential winner from the Canadian Province of Quebec, in which case any decisions that are within the jurisdiction of the Régie des alcools, des courses et des jeux will be subject to a ruling by the Régie). In the event: (a) a potential winner cannot be reached for whatever reason after a reasonable effort has been exerted based on the information stated in the entry, (b) of noncompliance with the above or within any of the aforesaid time periods, (c) a potential winner is found to be ineligible to enter this Promotion or receive the prize, (d) a potential winner cannot or does not comply with the Official Rules, (e) a potential winner’s prize notification or Affidavit is returned as undeliverable for whatever reason, (f) a potential winner fails to fulfill the Affidavit-related obligations, or (g) a potential winner declines to receive the prize, the potential winner shall be disqualified from this Promotion and an alternate potential winner may be selected from among the other eligible entries received at the sole discretion of the Sponsor.
The confirmed winner of the Promotion shall receive the Grand Prize awarded by Sponsor.
The Grand Prize shall consist of a two-night getaway for two (2) to the 2015 NHL All-Star Game (such game, the “All-Star Game”) to be held on or about January 25, 2015 in Columbus, Ohio, including (i) roundtrip coach airfare for two from a major airport near the winner's residence (as determined in Sponsor's sole discretion), within the contiguous United States or Canada (as may be applicable), and arriving at Port Columbus International Airport; (ii) 3 days/2 nights standard hotel accommodations (single room, double occupancy), at a hotel to be determined in Sponsor's sole discretion; (iii) two (2) tickets to the 2015 NHL All-Star Skills Competition and two (2) tickets to the All Star Game; (iv) ground transportation to and from the hotel; and (v) $500.00 (US$s) in spending money. Total ARV of the Grand Prize shall not exceed $3,000 (US$s). The actual value of the Grand Prize may vary depending upon the city of departure, date and times of travel, airfare fluctuations and hotel charges at the time of travel bookings. Actual value of the Grand Prize awarded may be lower or higher at the time of its fulfillment. Any difference between actual value and stated ARV (if actual value is lower than stated ARV) will not be awarded. Sponsor is not responsible if the All Star Game is delayed, postponed or cancelled for any reason, in which event that portion of the prize is forfeited in its entirety and no substitution will be provided except as in Sponsor's sole discretion. Trip must be booked at least twenty-one (21) days prior to departure. Travel and accommodations are subject to availability and blackout dates. Travel must be roundtrip. Sponsor will determine airline and flight itinerary in its sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel is subject to the terms and conditions set forth in these Official Rules, and those set forth by Sponsor's airline carrier of choice as detailed in the passenger ticket contract. All expenses and travel costs not expressly stated in the prize package description above, including but not limited to, ground transportation, meals, tips, incidentals, passenger tariffs or duties, surcharges, airport fees, baggage fees, service charges or facility charges, personal charges at lodging, security fees, state, federal or local taxes of any kind, or other expenses are solely the responsibility of winner and winner's travel companion. Any portion of the prize not accepted or unclaimed and/or unused by the winner will be forfeited and will not be substituted. Winner and winner's travel companion must be able to travel during the specific time period stated above or prize will be forfeited in its entirety and an alternate winner may be selected in Sponsor's sole discretion. Travel must originate and end at the same major U.S. or Canadian airport, as applicable, except as otherwise provided by these Official Rules. If, in the judgment of Sponsor, air travel is not required due to winner's proximity to prize location, ground transportation will be substituted for roundtrip air travel at Sponsor's sole discretion. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. Terms and conditions of all tickets apply. Specific seat locations will be determined by Sponsor in its sole discretion. Winner and winner's travel companion must travel on the same itinerary and are responsible for all necessary travel documents and for any travel insurance. If winner is not a citizen of the country to which they will be traveling, then winner and traveling companion must have valid passports and visas (with the term "valid" being defined as what is valid under Canadian, United States and/or any foreign laws) at the time of departure from Canada or the United States as the case may be including up to and including the time of return to Canada or the United States as applicable and in the event for any reason the winner does not have a valid passport/visa at the time of departure neither the winner nor their traveling companion may travel and the prize will be forfeited in its entirety and nothing will be substituted in its place but if at the time of departure the winner does have a valid passport/visa and traveling companion does not have a valid passport/visa the winner may travel though the winner may not substitute new traveling companion. Winner's travel companion must execute a liability/publicity release (except where prohibited by law) in order to accompany winner on trip. In the event that winner's travel companion is under the age of majority in his/her legal state or province of residence, the liability/publicity release must be executed by such minor's parent or legal guardian on its behalf. Liability/publicity release must be executed and returned prior to issuance of travel documents. Other travel restrictions, conditions and limitations may apply.
All prizes claimed will be awarded. ARV of all prizes is in U.S. dollars. All details and other restrictions of prizes not specified in these Official Rules will be determined by Sponsor in its sole discretion. Prizes are non-transferable, non-refundable and must be accepted as awarded. No cash or other substitutions may be made, except by Sponsor who reserves the right, in its sole discretion, to substitute a prize (or portion thereof) with another prize (or portion thereof) of equal or greater value whether due to the unavailability of a prize or prize component, or for any other reason. Winner is solely responsible for any and all applicable federal, state, local and/or any other applicable taxes and/or other costs and expenses associated with accepting, redeeming and/or using a prize which are not specifically mentioned herein. Without limitation, except where legally prohibited, acceptance of a prize constitutes a winner's agreement and consent for Sponsor to use the winner's first name and address (city & state) for purposes of advertising, promotion and publicity relating to the Promotion and for any and all other promotional and marketing purposes, in any and all forms of media, now known or hereafter devised, including, but not limited to, print, TV, radio, electronic, cable or World Wide Web, without additional compensation, limitation, restriction, notice, review or approval.
By participating in the Promotion, all Entrants, including, without limitation, the potential winner, agree to forever and irrevocably release, indemnify and hold harmless each of the Promotion Entities and each of their respective officers, directors, governors, partners, partnerships, principals, employees, volunteers, representatives, agents, affiliates, related entities, successors and assigns (collectively, the "Indemnified Parties"), from any and all liability, damages, property damage, injuries, death, claims, causes of action, cost or expense (including attorneys' fees), or losses of any kind arising from, in connection with or resulting from the Promotion and/or any element thereof, participation, entry or inability to participate in the Promotion, acceptance, possession, use or misuse of any prize or any part thereof, and/or the violation of any privacy, personal, publicity or proprietary right.
Sponsor reserves the right to terminate, cancel, suspend and/or modify the Promotion (with the consent of the Régie, as required under the Rules and Regulations of the Régie), if intervening circumstances warrant, within Sponsor's sole discretion, due to any fraud, virus or other technical problem which corrupts the administration, security, or proper play of the Promotion, or for any other reason. In such event, Sponsor reserves the right to award a prize from among the eligible Entries received up to the time of the termination, cancellation, suspension and/or modification. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In case of dispute as to the owner of an Entry or Registration, the Entry or Registration will be deemed to have been submitted by the authorized account holder of the e-mail address from which the Entry or Registration is made. The "authorized account holder" is defined as the natural person who is assigned an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address. A potential winner may be requested to provide the Sponsor or its designees with proof that the potential winner is the authorized account holder of the email address associated with the winning entry. If a dispute cannot be resolved, the Entry or Registration will be deemed ineligible, and an alternate potential winner may be selected in Sponsor's sole discretion. Promotion Entities make no warranties, and hereby disclaim any and all warranties, express or implied, concerning any prize. Without limiting the generality of the foregoing, such prize is provided "as is" without warranty of any kind, either express or implied, and Promotion Entities hereby disclaim all such warranties, including but not limited to, the implied warranties of merchantability, fitness for a particular purposes and/or non-infringement.
Promotion Entities are not responsible or liable for Entries that are: (i) entered by other than human means (such as by an automated computer program or any non-human mechanism, entity, or device), (ii) in excess of the stated entry limit, or (iii) illegible, late, forged, destroyed, lost, misplaced, stolen, misdirected, tampered with, incomplete, deleted, damaged, garbled, altered or otherwise not in compliance with these Official Rules, whether caused by any of the equipment or programming associated with or utilized in the Promotion, or by any technical or human error which may occur in the processing of Entries in the Promotion, or for failure to receive Entries due to transmission failures or technical failures of any kind and such Entries will be disqualified. By entering the Promotion, each Entrant agrees and acknowledges to be bound by the Official Rules, as well as the decisions of the Sponsor which are final and binding in all respects; to waive any rights to claim ambiguity with the Promotion or these Official Rules and that the Indemnified Parties shall have no responsibility or liability (including, but not limited to, liability for any property loss, damage, personal injury or death) in connection with: participation in the Promotion (including, but not limited to, changes in an Entrant's Entry or Registration information which affects the ability to contact such Entrant); typographical errors in Promotion promotional material; acceptance/possession, defects in, use, misuse or inability to use a prize; cancellations and/or delays or any change by any company or any other persons providing any component of a prize due to reasons beyond the control of any of the Indemnified Parties; any interruptions/postponement/cancellation of Promotion; human error; incorrect or inaccurate transcription of Entry or Registration Information; any technical malfunctions of the computer on-line system, computer dating mechanism, computer equipment, software, or internet service provider utilized by any of the Indemnified Parties or by Entrant; interruption or inability to access the Promotion, any Promotion-related Web pages, or any on-line service via the Internet due to hardware or software compatibility or other problems; any damage to Entrant's (or any third person's) computer and/or its contents related to or resulting from any part of the Promotion; any lost/delayed data transmissions, omissions, interruptions, defects; and/or any other errors or malfunctions, even if caused by the negligence of any one or more of the Indemnified Parties. Each Entrant hereby acknowledges that the Indemnified Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any of the prizes (or any components thereof). Entrants further agree that the Indemnified Parties shall not be liable for any injury, damage, loss, expense (including attorneys' fees), accident, delay, inconvenience or irregularity that may be caused or contributed to (1) by any wrongful, negligent or unauthorized act or omission on the part of any of the Indemnified Parties, or any of their agents, servants, employees or independent contractors, (2) by any wrongful, negligent or unauthorized act or omission on the part of any other person or entity not an employee of any of the Indemnified Parties, or (3) by any other cause, condition or event whatsoever beyond the control of any of the Indemnified Parties.
Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of the State of New York, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York, except that the laws of Canada shall apply vis-à-vis any Entrant who is resident in Canada as will the laws of any Province or municipality that apply to any respective Canadian Entrant and further for a resident of the Canadian Province of Québec any litigation respecting the conduct or organization of this publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling and any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement. The Supreme Court of the County of New York or the United States District Court for the Southern District of New York shall have jurisdiction and venue over all controversies arising out of, or relating to, the Promotion except where a Canadian Entrant is involved in which case the courts of the Province of Ontario shall have jurisdiction except in relation to where a matter within the jurisdiction of the Régie is involved in which case the courts of the Province of Québec shall have jurisdiction solely in relation thereto. Entrants hereby irrevocably consent to the personal jurisdiction of said courts and waive any claim of forum non conveniens or lack of personal jurisdiction they may have.
